Service provider
The service provider is Transfer PL JDG Henadzi Nabochanka, ul. Mysliwska 89a, 80-283 Gdansk, Poland, VAT ID (NIP) 9571176286 (“Provider”). Contact details are on the Contact page. These terms apply to bookings made on the Transfer PL website by individuals (including consumers) and businesses unless otherwise agreed in writing.
These terms take effect when published on the website. The current version is available at /terms. We may update them for important reasons (e.g. legal or service changes); for confirmed bookings we will inform you of material changes in a reasonable way.
Services covered
The Provider organises and performs private passenger transport (transfers) in Poland and, where offered, other EU countries, including airport and station pickups, city and intercity rides, international routes, and chauffeur-by-the-hour services according to your booking (pickup time and place, route or duration, passengers, vehicle class, luggage, extras). This is an individual service — the vehicle is for you and your party only, not shared with other customers. It is not public collective transport under Polish road transport law.
Booking and contract
Before submitting a booking you see service details, the price in PLN, payment options, and these terms on the website. A correctly completed form is an offer to conclude a contract. The transport contract is formed when the Provider confirms your booking (e.g. transactional email or “confirmed” status on the order page). The price shown before confirmation is based on route data you enter (including mapping data); after confirmation, the amount in the confirmation applies if route and parameters match the booking.
Consumers and right of withdrawal
The following applies if you are a consumer under Polish law of 23 April 2014 on consumer rights and EU Directive 2011/83/EU:
- Under Article 38(12) of the Polish Consumer Rights Act, the 14-day right of withdrawal for distance contracts does not apply to passenger transport services where the contract specifies the date of performance — your pickup date and time are set at booking.
- Cancellation or rescheduling follows the “Cancellation” and “Changes” sections below, not the statutory withdrawal procedure.
- You retain mandatory rights under Polish and EU law (including remedies where applicable to the nature of the service) that cannot be excluded by contract.
Prices and payment
Prices are in Polish zloty (PLN). The confirmed amount includes VAT where applicable per your invoice or receipt. Payment options: on site (cash or card where offered) or online in advance via Stripe. Card data is processed by Stripe; we do not store full card numbers. Failed, delayed, or disputed online payments may delay confirmation or performance until resolved. No extra card-processing fee unless stated at booking.
Cancellation by you
Where self-service cancellation is available, you may use it until 24 hours before the scheduled pickup (Europe/Warsaw). After that, cancellation may require contacting support and operator approval. Cancelling a confirmed booking with online payment does not trigger an automatic refund — eligible refunds are assessed individually under these terms and Stripe rules; bank processing may take several business days.
Changes, delays, and no-show
Changes to address, route, passenger count, or time after confirmation require Provider approval and may incur extra charges or make the original slot impossible. You must provide a valid phone number and monitor messages (email/SMS if sent). Late arrival without contact, wrong pickup details, no-show, or refusal to start the ride without justified cause on the Provider’s side may result in a charge up to the confirmed trip price, subject to mandatory law.
How the ride is delivered
The Provider will perform the ride as confirmed, with due care:
- The driver aims to arrive at pickup at the agreed time; for airport pickups we consider the flight number if provided and reasonable time for baggage and exit.
- Name board at pickup when selected for airport transfers.
- Vehicle matches the confirmed class or equivalent; luggage and seats must fit the booking — contact us before the trip if unsure.
- Passengers must follow law and safety rules (seat belts, no smoking, no dangerous behaviour). The Provider may refuse or stop the ride for serious violations.
Liability
The Provider is liable for damage from non-performance or improper performance under the Polish Civil Code and, where relevant, road transport and EU rules, subject to mandatory limits for consumers. We are not liable for delay or failure caused by force majeure, traffic, authorities, airport events, or third parties beyond our control; if performance is impossible we seek to offer an alternative or refund as required by law.
Complaints
Complaints about the ride or billing should be sent to the email on the Contact page with booking code, trip date, and description. We handle complaints promptly, within 14 days of receipt, as required by Article 7a of the Polish Consumer Rights Act. Replies are provided on a durable medium (e.g. email). For personal data, see the Privacy Policy and GDPR.
Out-of-court dispute resolution
Consumers may use local consumer ombudsman services or go to court under applicable rules (including consumer jurisdiction in EU/Polish law). Information on authorised ADR bodies is published by the Polish competition authority (UOKiK, uokik.gov.pl). The EU ODR platform was withdrawn from mandatory trader information on 20 July 2025; you may still contact us to resolve matters amicably before court.
Electronic services
The website lets you book and view order status under Polish law on electronic services. You need a current browser and internet access. We strive to keep the site available but technical breaks, maintenance, or map errors may occur — contact us to complete a booking by another channel if needed. Site content (routes, fleet photos) is informational; the binding terms are in your booking confirmation.
Governing law and courts
Polish law applies to contracts under these terms. For consumers resident in another EU country, mandatory rules of that country also apply if they offer wider protection. Disputes with business customers without consumer status are subject to courts competent for the Provider’s seat unless special rules provide otherwise.
Personal data
The Provider above is the data controller. Processing (purposes, legal bases, recipients, retention, cookies, your rights) is described in the Privacy Policy at /privacy.
